Regulations for the provision of electronic services by Unitop sp. z o.o. with its registered office in Łódź

§ 1. Definitions

The terms used in these Regulations have the following meaning:

Electronic address – designation of the ICT system that enables communicating by means of electronic communication, in particular by e-mail (e-mail address),

Website – www.amkisnacks.com

ICT system – a set of cooperating IT devices and software, ensuring the processing and storage, and also sending and receiving, of data via telecommunications networks using a terminal device appropriate for a specific type of telecommunications network within the meaning of the Act of 16 July 2004 – Telecommunications Law,

Provision of electronic services – performance of the Service, by sending and receiving data using ICT Systems, at the individual request of the User, without the simultaneous presence of the parties, where the data are transmitted using public networks within the meaning of the Act of 16 July 2004 – Telecommunications Law,

Service Provider – Unitop sp. z o.o. with its registered office in Łódź (ul. Andrzeja Struga 61, 90-959 Łódź), entered in the National Court Register kept by the District Court for Łódź-Śródmieście, 20th Commercial Division of the National Court Register, KRS 0000616626, REGON: 364407260, NIP: 5252658641.

Services – the services provided by the Service Provider via the Website using the ICT System, as referred to in Article 3 paragraph 1 of these Regulations,

Act – the Act on the provision of electronic services of 18 July 2002,

User – a natural person, legal person or organisational unit without legal personality, using the Services provided by the Service Provider via the Website.

§ 2. General provisions

These Regulations define:

the rules for using electronic services, available on the Website, including in particular the rights and obligations of the Service Provider and the Users,

the scope and types of electronic services provided via the Website.

The Users are required to read these Regulations before using the Services and comply with the provisions hereof.

The Service Provider provides electronic Services in accordance with the Regulations and the Act.

The Regulations are made available to the Service Recipient free of charge on the website www.amkisnacks.com.

§ 3. The scope of electronic services

The Service Provider provides the following Services via the Website:

presenting some of the Service Provider’s products and other information about the Service Provider, including contact details, on the website www.amkisnacks.com, to enable the User to familiarize himself or herself with the presented products of the Service Provider and establish contact with the Service Provider in order to obtain information about the offer, availability and scope of products and services provided by the Service Provider as part of the business activities.

the contact form, hereinafter referred to as the “Contact Form”, which involves making the tool available to Users free of charge to contact the Service Provider in order to obtain information about the offer, availability and scope of products and services provided by the Service Provider as part of the business activities.

The content made available on the Website is the exclusive property of the Service Provider.

§ 4. Terms and conditions of the provision of electronic services

Computer equipment with an installed web browser and access to the Internet are required for the proper use the Services.

For the Contact Form, it is also necessary to have an active e-mail account.

The Service Provider reserves the right to:

refuse to provide Services in the event of a breach by the User of these Regulations or the provisions of generally applicable law or the User taking any actions that interfere with the uninterrupted use of the Website or Services by other Users,

refuse to provide Services if the User provides incorrect or untrue data required to respond to the inquiry sent via the Contact Form,

cease the provision of Services, either temporarily or permanently, due to maintenance or modification of the Website.

Users who use the Services via the Website are required:

not to send any illegal content that infringes on the third parties’ personal rights protected by law, and copyrights,

not to use the Services contrary to the law, these Regulations or good practice, or in a manner infringing on the Service Provider’s personal rights.

§ 5. Conclusion and termination of the contract for the provision of electronic services

1. Commencing the use the Services is tantamount to concluding a contract for the provision of electronic services with the Service Provider and accepting the Regulations. Before concluding a contract for the provision of electronic services, the User is required to read the content of the Regulations.

The contract is concluded at the time of:

opening the Website www. amkisnacks.com – for the Website;

sending a message via the Contact Form; when the fields of the Contact Form have been correctly filled in – for the Contact Form.

The contract for the provision of electronic services is concluded for the duration of these services, i.e.:

for the Website – until the website is closed;

for the Contact Form – upon sending a response to the User’s inquiry, which was sent via the Contact Form available on the Website, or upon exiting the Contact Form.

The conclusion of the contract for the provision of electronic services does not involve any fees to be paid by the User to the Service Provider.

The User may use the services anonymously, i.e. without providing any personal data, except for the Contact Form.

In order to use the functionality of the Contact Form, the User must provide his or her first name and e-mail address, and the User must read these Regulations.

The User has the right to opt out of the Contact Form service before receiving a response to the inquiry sent. To do this, the User simply needs to exit the Website.

If the inquiry has been sent via the Contact Form and the User no longer wants to receive a response to the inquiry, the User may opt out of the Contact Form service by sending a statement of opting out of the Contact Form service to the Service Provider to the e-mail address marketing@unitop.com.pl from the electronic address (e-mail) that has been provided via the Contact Form.

The Service Provider reserves the right to cease to provide the Services at any time.

§ 6. Responsibility of the Service Provider

The Service Provider is not responsible for:

interrupted access to the Services, resulting from the necessary technical and administrative procedures,

disruptions in the Internet service, Internet supply and interrupted access to the Services caused by force majeure,

cessation of the provision of Services to Users who have breached these Regulations,

damage caused to third parties as a result of the Users using the Services contrary to the Regulations and the provisions of generally applicable law,

refusal to provide Services if the User provides incorrect or untrue data required to respond to the inquiry sent via the Contact Form,

cessation of the provision of Services, either temporarily or permanently, due to maintenance or modification of the Website,

cessation of the provision of Services by the decision of the Service Provider.

For security reasons, in order to repair faults and eliminate possible risks, the Service Provider reserves the right to temporarily suspend the Website in order to modify or update data or change the content of the Website. The Service Provider is not responsible for any of the above-mentioned situations.

§7. Complaint handling procedure

The Users have the right to file complaints regarding the provision of the Services.

The complaint may involve any objection or concern related to the provision of the Services.

Complaints should be sent to the e-mail address: cok@unitop.com.pl or in writing to the Service Provider’s address indicated in these Regulations.

The Service Provider will process each complaint within 21 days from the date of its receipt and reply to the e-mail address from which the complaint has been sent, unless the User filing the complaint has indicated a different address, either traditional or electronic, for responding.

The complaint should contain all information required to process it. If any additional information is required to process the complaint, the Service Provider will contact the User filing the complaint and ask the User to provide such information.

§ 8. Miscellaneous

The Service Provider is authorised to unilaterally amend the Regulations for important reasons, including in particular changes in law if those affect the implementation of the provisions of the Regulations.

The Service Provider is required to notify the User of each amendment to the Regulations by posting the information on the Website.

In matters not covered by these Regulations, the relevant provisions of generally applicable law shall apply, including in particular the provisions of the Act.
